MainBoss Basic Licensing Agreement and Warranty
All MainBoss software products are protected by both Canadian Copyright Law and International Treaty provisions.
MainBoss Basic CMMS Licenses
MainBoss CMMS is licensed by the number of concurrent users, i.e. the number of MainBoss CMMS users who can simultaneously connect with a MainBoss database. (A MainBoss database is an interrelated collection of data files providing comprehensive information about a unified set of maintenance activities.) The MainBoss CMMS software package may be installed on any number of computers, provided the computers are all configured to refer to the same collection of database files. If the maximum number of users allowed by your license have already connected to the database, additional users will not be allowed to connect.
MainBoss Service Desk licenses
MainBoss Service Desk is also licensed by the number of concurrent users, i.e. the number of MainBoss Service Desk users who can simultaneously connect with a MainBoss database. The MainBoss Service Desk software package may be installed on any number of computers, provided the computers are all configured to refer to the same collection of database files. If the maximum number of users allowed by your license have already connected to the database, additional users will not be allowed to connect.
MainBoss @Requests
Your MainBoss @Requests may set a limit on the number of requestors who can submit email work requests via the software. A requestor is identified by email address. Therefore, the limit on requestors is the limit of email addresses that may appear in the address list maintained by @Requests. @Requests will not let you add addresses to the list once you have reached this limit (although you may delete existing addresses from the list and thereby free up space for new addresses). Note that an unlimited license sets no limit on the number of requestors.
Test Databases
You may freely create MainBoss databases in order to evaluate or test features of software products you have licensed. You may also create such databases in order to test other software that works with MainBoss files (for example, software you have written to extract information from MainBoss files and produce customized reports). Such databases may only be used for the purpose of software testing—they must not be used to conduct actual maintenance work.
Demonstration Copies
People who receive a demonstration copy of any MainBoss product are permitted to use the software for demonstration purposes, for up to 30 days from the time of receipt. After that, you must either discontinue using the MainBoss product or purchase a license for the software.
You may not attempt to circumvent the protections used by the demonstration software to remain in demonstration mode.
Warranty and Liability
Thinkage Ltd. warrants that it has title to the MainBoss Maintenance Software Programs free of any lien, charge, encumbrance or claim. Title to the programs and any materials associated therewith shall at all times remain in Thinkage Ltd.
Thinkage Ltd. makes no representation with respect to the adequacy of these Programs for any particular purpose, or with respect to their adequacy to produce any particular result.
The User agrees to absolve Thinkage Ltd. of any responsibility for losses, costs, damages, or expenses of every nature or kind due to use of the Programs.
If the User finds the programs unsatisfactory in any way, the User's sole recourse is to request a refund of moneys already paid to Thinkage Ltd., within 30 days of purchase. In this case, Thinkage Ltd. will return this amount to the User in a timely manner. When the money has been returned, the User will destroy all of its copies of the programs and any products derived from the programs, and will cease to use the programs in any way.
